Competition Terms

Blippar Limited, registered with company number 11787934 at 49 Upper Brook Street, Mayfair, London, United Kingdom, W1K 2BR (“Blippar”, “we”, “our”, “us”) coordinates the “Blippbuilder Creation Competition” (the “Competition”) as featured on https://www.blippar.com.

The Competition will be operated in accordance with these terms and conditions and the Blippar terms of service (“Terms of Service”) which can be found here.

ACCEPTANCE

By participating in the Competition, you are indicating your acceptance of these terms and conditions and the Terms of Service and by our decisions, which are final in all matters relating to these terms and conditions, the Competition and the results. If you do not agree to these terms and conditions and the Terms of Service, you should not apply to enter the Competition.

  1. ELEGIBILITY
    1. You may only enter the Competition:
      1. if you are aged 13 years or older. If you are under the age of 18, you must obtain the consent of a parent or guardian before entering.
      2. have a valid Blippar user account; and
      3. have a valid email account.
    2. You cannot enter the Competition if you or any person related to you is an employee, consultant or agent of Blippar or any of its affiliates.
  2. COMPETITION ENTRY
    1. By creating and uploading new and original augmented reality content created on our BlippBuilder software tool to our website (https://www.blippar.com) during the Competition Period (“Submission”) you will be automatically entered into the Competition.
    2. There is no charge for entering the Competition. A purchase of any kind does not increase the chance of winning the Competition in any way.
    3. There is a limit of one entry to the Competition per person.
    4. We can refuse a Submission for any reason, without notice to you. We will not accept any Submission which we consider to be incomplete, misleading, late or inappropriate. Submissions which could be considered to be racist, homophobic or otherwise discriminatory in any way will be disqualified and shall not be deemed to comply with these terms and conditions.
  3. DETERMINATION OF WINNER, NOTIFICATION AND PRIZE COLLECTION
    1. After the end of the Competition Period, the ten (10) winners of the Competition will be selected (the “Winners”), from amongst valid Submissions. The Winners will be selected from the Submissions by the team at Blippar or by judges appointed by Blippar.
    2. In the event that there are not enough Submissions to award the Prizes, Blippar reserves its right not to award prizes or to award fewer than ten (10) prizes in its absolute discretion.
    3. Winners will each be notified by email. Winners will have seven (7) calendar days from being notified of their win to reply to the notification message accepting the prize and providing all the information requested by Blippar.
    4. The notification to the Winners may be made public and the selection of the Winners by Blippar is final.
    5. The Prize will be sent to the Winners via post.
    6. The Winners may be requested to participate in promotional activity. By entering the Competition, the Winners consent to the use of their name and/or Submission in any publicity carried out by Blippar.
    7. Blippar reserves the right to require Winners to provide a valid form of identification proving their age and identity before receiving their Prize. Any identity verification document produced must be in the name of the person who has entered the Competition.

  4. PRIZE
    1. Each Winner will get a pair of Nreal Air Glasses (the “Prize”).
    2. Prizes are subject to availability and are not transferable or negotiable. There is no cash alternative for prizes. Upon Prize forfeiture, no compensation will be given.
  5. RESERVATIONS AND LIMITATIONS.
    1. We can exclude any Submissions if we have a reasonable belief the entrant has breached these terms and conditions or the Terms of Service, or the spirit of these terms and conditions or the Terms of Service.
    2. We are not responsible for any loss, damage or delay caused:
      1. by your participation in the Competition;
      2. by third parties, including losses, damages or delays caused by fraud or any communication network; or
      3. as a result of any incorrect or incomplete information provided by any entrant.
    3. We do not limit our own liability for death or personal injury, fraud or fraudulent misstatement.
    4. Blippar reserves the right to cancel the Competition at any time, for any reason.
    5. Blippar will not accept:
      1. responsibility for Submissions that fail to transmit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of transmission as proof of receipt of a Submission by Blippar.
  6. INTELLECTUAL PROPERTY
    1. Blippar does not claim any rights of ownership in entrants’ Submission content.
    2. You agree that Blippar may, but is not required to, make Submissions available on its website, and any other media and social media, including in marketing materials, in connection with any reasonable publicity of the Competition. You agree to grant Blippar a royalty-free, non-exclusive, worldwide, irrevocable licence, for the full period of your intellectual property rights in the Submission (if any are applicable) and any accompanying materials that you provide to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-license the Submission and any accompanying materials for such purposes.
    3. You also consent to Blippar doing (or omitting to do) any act in respect of your Submission that may otherwise constitute an infringement of your moral rights.
    4. You acknowledge that other entrants may have used ideas and/or concepts in their Submission that may be similar in idea or concept to what is included in your Submission. You understand and agree that you shall not have any claim against any other entrant or Blippar arising out of any such similarity or be entitled to any compensation because of any such similarity.
    5. For the purposes of this Competition only, in the event of any inconsistency between this clause 7 and clause 6 of the Terms of Service with respect to Blippar’s use of Customer Materials, the provisions of this clause 7 shall prevail.
  7. DATA PROTECTION AND DIRECT MARKETING
    1. By agreeing to these terms and conditions, you are giving your consent to us to:
      1. process your personal data;
      2. disclose your personal data to our affiliates;
      3. disclose your personal data to third parties, but only to the extent necessary for that third party to deliver the Prize;
      4. use your name and Submission in promotional materials or marketing activity;
      5. transfer your data outside of the European Economic Area; and
      6. send you emails about related products or services.
    2. You must let us know if any of your personal data is incorrect or becomes out of date.
    3. If you want to withdraw your consent, you can do so at any time by writing to: social@blippar.com. If you withdraw your consent, you will not be eligible to participate in the Competition or win the Prize.
  8. APPLICATION OF THESE TERMS & CONDITIONS AND APPLICABLE LAW.
    1. We can change these terms and conditions at any time and those changes may take retrospective effect.
    2. If there is any inconsistency between these terms and conditions and the Terms of Service from time to time, these terms and conditions will take precedence.
    3. These terms and conditions will be governed and interpreted according to English law and subject to the exclusive jurisdiction of the relevant English courts.
